In today's episode, I analyze use and derivative use immunity, which is the type of immunity that Wendi Adelson holds as a result of her trial testimony under state subpoena in the 2019, 2022 and 2023 trials relating to the murder for hire of her ex-husband, FSU Law Professor Dan Markel. Specifically, I explain the holding in Kastigar v. United States, 406 U.S. 441 (1972), and how it might relate to Wendi Adelson, should she ever be charged in connection with her ex-husband's murder.
