Author Diane Cafferata's day job is fearsome litigator. For more than 20 years, she has been a partner at Quinn Emanuel Urquhart & Sullivan, the world’s largest and most successful all-business-litigation firm, where she litigates a variety of complex commercial matters in federal and state courts nationally. In 2023, she was named a Southern California's Super Lawyers by Los Angeles Magazine for the twelfth year in a row.
In recent years, Cafferata expanded her financial litigation practice. She represented the Lehman Brothers Estate in financial derivatives matters against JP Morgan, Citibank and Credit Suisse. Those settlements recovered billions for the Estate. For this and related work she was named one of LawDragon’s 500 Leading Plaintiffs Financial Lawyers in 2019-2022. Cafferata has represented Northrup Grumman, Mattel, Qualcomm, Samsung and others in high-stakes intellectual property matters, as well many smaller companies and even individual clients who need to realize extraordinary litigation results with a smaller litigation budget.
Cafferata attributes her success in large part to her deep understanding and appreciation of the businesses she represents. Cafferata draws from her Stanford MBA and her breadth of experience to develop and execute creative strategies that bring her clients better litigation results, even in the most challenging cases. As a seasoned trial lawyer, she focuses on the merits of a dispute from its inception, and uses that focus to conserve her clients’ resources while getting them superior results, whether at trial or the settlement table.
Recognizing that many businesspeople would benefit from a greater understanding of the litigation process, in July 2020, Cafferata published Business Litigation Demystified (Little Phoenix Publishing), which hit #1 in four Amazon categories in its first week. Business Litigation Demystified is a readable and entertaining overview of the U.S. litigation process. It provides background to business executives, managers and lawyers in domestic and foreign companies. This enables them to have more meaningful conversations with their outside counsel, and make better, more informed decisions around dispute resolution issues.
In April 2023, Cafferata launched Business Litigation Demystified Discussion Guide (Little Phoenix Publishing), which was designed to facilitate the use of Business Litigation Demystified in an undergraduate or graduate business curriculum, or in a business litigation course for law students who may not plan to specialize in litigation themselves. It contains practical, engaging business litigation questions that inspire students to analyze, compare, criticize, and apply the key lessons of Business Litigation Demystified. Answers are provided at the end of each chapter, to stimulate lively classroom discussion.
When Diane is not advocating for her clients, she enjoys racing Porsches, teaching performance driving, hiking, cooking, and writing.
