• Can a Convicted Felon Run for President
    Nov 15 2024

In today's episode of Lest We Forget Historical, host Lillian Cauldwell discusses the 14th Amendment and its provisions about whether a convicted candidate running for President is banned from taking office if convicted of being a felon.

After a fact check, it is established that nowhere in the US Constitution does it prohibit anyone from taking office unless they have taken an oath to uphold the Constitution and "engaged in insurrection." However, in March 2024, the Supreme Court required that Congress act for it to be enforced.

  • The First Amendment and the Supreme Court
    Oct 16 2024

In this episode of 'Lest We Forget Historical,' host Lillian Cauldwell discusses the Constitution's First Amendment. She explores the viewpoint of a potential presidential candidate who strongly believes that individuals should not have the right to criticize the Supreme Court's decisions and advocates for the prosecution and imprisonment of those who disagree with the high court's decision.

It has only been since the mid-20th century that the freedom of speech was granted to American citizens. Ms. Cauldwell presents two landmark cases: one by Chief Justice Vinson in Dennis v. United States in 1951, and another by early 20th-century Justice Oliver Wendell Holmes, who developed a framework that continues to influence First Amendment law today.

  • Is the First Amendment in danger
    Oct 11 2024

In this episode of Lest We Forget Historical, host Lillian Cauldwell discusses recent comments made by potential Republican presidential candidate Donald Trump. He suggested that critics of the Supreme Court should be jailed for disagreeing with the Justices' decisions. This is not unprecedented; individuals have been imprisoned for expressing their views throughout history.

For instance, near the end of World War I, union leader Eugene Debs was sentenced to 10 years for a speech against the draft, a conviction upheld by the Supreme Court. In 1951, during Senator Joseph McCarthy's anti-communist crusades, the Supreme Court supported such actions by affirming the convictions of those who attempted to form a Communist Party in the U.S. It was only in the 1960s that the Court issued decisions protecting political activists and the freedom of the press. These protections could vanish if the Court's current majority favoring free speech changes.
